4.3 Service Availability

While we strive for 99.9% uptime, we do not guarantee that our Services will be uninterrupted, timely, secure, or error-free. We may perform scheduled maintenance, which may temporarily affect service availability.

5. Revenue Sharing and Payments

5.1 Revenue Split

Approved partners participate in our 50/50 revenue sharing model. You retain 50% of the net revenue generated from your products and services on our platform, while Creator AI Hub receives 50%. Revenue calculations are based on gross revenue minus applicable taxes, payment processing fees, and refunds.

5.2 Payment Terms

Payments to partners are processed according to the following terms:

• Payments are made monthly, within 15 business days after the end of each month
• Minimum payout threshold: $100 USD (or equivalent in your currency)
• Payment methods: Bank transfer, PayPal, or other approved methods
• You are responsible for providing accurate payment information
• You are responsible for all applicable taxes on your earnings

5.3 Refunds and Chargebacks

Refunds and chargebacks will be deducted from your share of revenue. Excessive refund rates may result in account suspension or termination. You are expected to provide quality products and services to minimize refund requests.

6. User Conduct and Prohibited Activities

You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Impersonate any person or entity or misrepresent your affiliation
• Upload or distribute viruses, malware, or malicious code
• Engage in fraudulent activities or payment manipulation
• Spam, harass, or abuse other users or our support team
• Scrape, crawl, or harvest data from our Services without permission
• Reverse engineer, decompile, or disassemble our software
• Use automated systems or bots to access our Services
• Sell, rent, or sublicense access to our Services
• Create or distribute content that is illegal, harmful, or offensive
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to our systems or user accounts

9. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our total liability to you for all claims arising from or relating to the Services shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@creatoraihub.net to resolve the dispute informally. We will attempt to resolve disputes within 60 days.

12.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action lawsuit.

12.3 Exceptions

Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of the Services.

13. Termination

You may terminate your account at any time by contacting us or using the account settings. We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to our Services, other users, or our business interests.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware.
